High court rules farmers can sue Dow Chemical
WASHINGTON Peanut farmers in Texas can continue with a lawsuit they filed against Michigan's Dow Chemical after the company's weed killer destroyed their crops.
The U-S Supreme Court ruled in the case today, reinstating the farmers' claims that Midland-based Dow failed to warn of possible risks.
A lower court had dismissed the claims against a Dow subsidiary.
The lower court said federal law bars states from imposing labeling requirements other than those set by the federal Environmental Protection Agency.
In today's opinion by Justice John Paul Stevens, the high court ordered the New Orleans-based Fifth U-S Circuit Court of Appeals to take a second look at the case.
