The Honorable Judge Denise Page Hood signed an Order resetting cure deadlines. A copy of the Order may be downloaded from "News Updates" on this website. Please read the Order carefully since it provides different cure deadline dates for each option in Classes 5, 6.1, 6.2 and Classes 9, 10.1 and 10.2. All claimants or their lawyers who have a cure deadline date should already have received notice. We encourage all Claimants who have a Rupture or Disease cure deadline pending to attempt to obtain additional records or information which may be used to cure your deficiencies. If you have moved to a new address and have not received a deficiency mailing recently, please call Claims Assistance so that we may provide you with deadline information and how to update your address.

PLEASE NOTE THAT THE CLAIMS ADMINISTRATOR HAS EXTENDED THE DEADLINE TO SUBMIT THE CLAIM FORM FOR THE EXPEDITED RELEASE OPTION FOR CLASSES 5, 6.1 AND 6.2. The deadline was June 1, 2007. This date has been extended to June 1, 2019. This extension only affects claimants in Classes 5 and 6 who have not already elected the Disease or Expedited Release Option. You must have acceptable proof of a Dow Corning Breast implant before you are eligible to receive the Expedited Release payment.

The Settlement Facility – Dow Corning Trust (SF-DCT) continues to process Class 7 (Silicone Material) claim submissions. To facilitate processing, the Debtor's Representatives and the Claimants' Advisory Committee have approved a special disease cash offer of $3,000 for Silicone Material Claimants who requested a disease review on their claim form, but because of the delay in processing, may choose to accept a one-time payment offer instead of waiting for a disease review. A disease review may take as long as 24 to 36 months, and even longer. Please note that if you are represented by an attorney, the Cash out option of $3,000 is subject to attorney fees as outlined in the Claimant Information Guide.

As new eligible Class 7 claims are processed, claimants who selected to be reviewed for Disease will receive the $3,000 Disease Cash-Out option. PLEASE NOTE: THE DEADLINE FOR REJECTING THE $3,000 CASH OUT OPTION HAS BEEN EXTENDED TO 180 DAYS AFTER THE DATE OF THE CHECK.

SF-DCT also will continue to make Expedited Release payments of $600.00 to eligible Silicone Material Claimants as the Proof of Manufacture is reviewed and found to be acceptable. The Expedited Release payment is not subject to attorney fees but attorneys may deduct certain expenses that are solely attributable to the claim as outlined in Judge Hood's Order regarding expenses.

The initial processing of Class 7 claims relied on MDL-926 claims data. If this information was incomplete, SF-DCT may require claimants to submit additional documentation in order to complete their claim reviews.
