Note: The approval percentages for Disease Options 1 and 2 include those claims that were previously approved by the MDL 926 Claims Office and are pass through claims in the Settlement Facility (i.e., the claimant had an implant from Bristol, Baxter or 3M and a breast implant from Dow Corning and has applied to receive 50% of her disease award in the Dow Corning case). As a result, the percentage of approved Disease claims processed by the Settlement Facility is actually lower.

3. UPDATE ON NOI CLAIMS SETTLEMENT STATUS
As noted in prior CAC e-newsletters, there has been a settlement that now allows timely NOI claimants to apply for and, if eligible, receive benefits for Explant and Rupture. The SF-DCT is preparing to mail information about this settlement to timely NOI or Conditional claimants in the next few weeks.
The deadline for timely NOI claimants covered by the settlement to apply for Explant and Rupture benefits is October 20, 2008. This means that timely NOI claimants who want to recover for Explant ($5,000 U.S.) and/or Rupture ($20,000 U.S. Base Payment) must have their Dow Corning breast implants removed and their claim forms submitted to the SF-DCT by October 20, 2008. Please note that this deadline applies ONLY to NOI claimants. It does not apply to timely filed claimants.
NOI Claimants who are eligible and who want to accept the settlement now can sign and submit an "NOI Acceptance Form." A copy of this form will be on the CAC website’s Home Page and also under the heading of "Rule 3005/Notice of Intent Issues."

Please mail all forms early enough so that they are received by the deadline listed below.
